# Terms of Service

These Terms of Service ("Terms") govern your access to and use of amiroud.com and the related websites, stores, applications, products, experiences, communications, and services operated by JORAID INC, doing business as Amir Oud Fragrance ("Amir Oud," "we," "us," or "our") (collectively, the "Services"). Our online store is powered by Shopify.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms disclosed for a particular product, promotion, event, appointment, or service also apply.
## Eligibility and accounts
You must be legally capable of entering a binding agreement and meet any age requirements applicable to a product or service. You are responsible for providing accurate, current information and protecting your account credentials. Notify us promptly of suspected unauthorized account use.
## Products and orders
Product descriptions, images, availability, and pricing may change. Fragrance color, presentation, and perceived scent may vary because of ingredients, production, storage, screen display, and individual perception. We may limit quantities, reject, cancel, or reduce an order, or correct pricing and description errors. If we cancel after payment, we will refund the canceled amount.
Prices are shown in the currency indicated at checkout. You are responsible for applicable taxes, shipping, duties, customs, clearance, and import charges. Products are intended for lawful personal use unless we expressly agree otherwise.
## Payment
You authorize us and our payment providers to charge the payment method selected at checkout. Payment information is processed under the providers’ terms and privacy practices. If payment is rejected or reversed, we may suspend fulfillment and seek amounts lawfully due.
## Shipping and delivery
Processing and delivery estimates are not guarantees. Weekends, holidays, high-volume periods, weather, carrier disruptions, customs, restricted fragrance shipping, and circumstances outside our reasonable control may cause delays. Available carriers and rates are shown at checkout and may change.
Risk and responsibility for a shipment are determined by applicable law and the shipping terms presented at checkout. Contact us promptly about a missing, damaged, refused, or undelivered shipment so we can review tracking, insurance, and carrier remedies. Shipping charges are not refundable except where required by law or where the loss resulted from our error.
## Returns, refunds, and exchanges
Our Return and Refund Policy is incorporated into these Terms. It explains request deadlines, authorization requirements, product eligibility, exclusions, return shipping, inspection, and refund timing. If a product-specific term conflicts with that policy, the product-specific term controls to the extent permitted by law.
Opened or altered fragrance and cosmetic products may be ineligible for return for hygiene and safety reasons unless defective, damaged, incorrectly supplied, or otherwise returnable under applicable law. Contact us before returning any product. Unauthorized returns may be refused.
## Promotions and price adjustments
Promotions, discounts, bundles, coupons, gifts, and rewards are subject to their displayed rules, availability, dates, and exclusions. Unless expressly stated, offers cannot be combined, have no cash value, do not apply retroactively, and may exclude shipping, taxes, gift cards, clearance items, or prior purchases. We may correct, suspend, or end a promotion where permitted by law.
Eligible full-price purchases may receive a price adjustment if the identical item is offered by us at a lower price within 14 days of the original purchase. The item must remain available in the same size, scent, and type and cannot be final sale or clearance. Requests must come directly from the purchaser with proof of purchase. Other exclusions disclosed with an offer may apply.
## Appointments, queues, and events
Appointments, AmirQ queues, and Event Go experiences may have capacity, timing, arrival, rescheduling, cancellation, and participation rules disclosed at booking or registration. Queue positions and service-time estimates may change based on operations. Private guest or queue links are intended only for the recipient and should not be shared.
## SMS terms
Amir Oud offers optional transactional SMS programs for staff, customers, and event guests. Staff may opt into operational messages through Amir Oud Office. Customers and event guests may separately opt in when joining an AmirQ or Event Go queue. Messages may include work alerts, private links, queue position, turn, visit, order, purchase-status, and fragrance-ready updates.
Message frequency varies; a one-time seat-link request generates one message, while an active queue, event, or staff workflow may generate recurring operational updates. Message and data rates may apply. Consent is optional and is not a condition of employment, purchase, or event participation. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. We may change or discontinue a messaging program. See our Privacy Policy for data practices.
## Intellectual property
The Services and their content—including trademarks, names, logos, text, photographs, graphics, product presentation, software, and designs—are owned by or licensed to Amir Oud and protected by applicable law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for lawful personal purposes. No other rights are granted.
## Acceptable use
You may not misuse the Services; violate law or third-party rights; interfere with security or operation; introduce malicious code; scrape, copy, reverse engineer, or exploit the Services without authorization; impersonate another person; submit false information; send unsolicited communications; or use the Services for fraud or unlawful resale.
## Reviews, feedback, and submissions
You represent that content you submit is lawful, accurate, and does not violate another party’s rights. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, publish, display, and use submitted content for operating, improving, and promoting the Services, subject to our Privacy Policy. We may remove content but are not obligated to monitor it.
## Third-party services and links
The Services may rely on or link to Shopify and other third-party services. We do not control third-party content or practices. Your use of those services may be governed by separate terms and policies.
## Disclaimer of warranties
To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” without warranties not expressly stated. We do not guarantee uninterrupted, secure, or error-free access or that all descriptions, content, or results will be complete or accurate. These disclaimers do not limit non-waivable warranties or consumer rights.
## Limitation of liability
To the fullest extent permitted by law, Amir Oud and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services. Our aggregate liability for a claim will not exceed the amount you paid us for the product or service giving rise to that claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
## Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Amir Oud and its affiliates, personnel, and providers from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, your content, or your material breach of these Terms. This provision does not apply to the extent a claim results from our own unlawful conduct.
## Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Subject to applicable consumer law, disputes will be brought in the state or federal courts serving Collin County, Texas, and the parties consent to those courts’ jurisdiction.
## Changes, suspension, and termination
We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively unless law permits otherwise. We may suspend or terminate access for material violations, unlawful conduct, fraud, security risk, or misuse. Provisions that by their nature should survive termination will survive.
## General terms
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms, the Privacy Policy, the Return and Refund Policy, and applicable checkout or service terms form the agreement regarding the Services.
